정책 지원·산업영향분석 등 강화된 무역안보관리원의 업무 기능을 반영한 「대외무역법 시행령」 개정 (‘24.10.8. 시행)
• ’24.8.21., 무역안보 환경변화와 국제적인 수출통제 강화 추세를 고려하여 ‘24.2.20. 개정된「대외무역법」(이하 “개정법”)이 시행됨
1. 전략물자 지정 근거 추가 - “국제수출통제체제에 준하는 다자간 공조”에 따른 전략물자 지정 근거 마련
2. 전략물자관리원 → “무역안보관리원” 개편 - 정책 수립 지원, 산업영향분석 등 기능 강화
3. 집행기능 강화 - 조건부허가 조건 미이행시 벌칙, 이동중지명령 위반시 수출입제한, 그 외 과태료 규정 정비
• 개정법 시행에 따라, ’24.10.8., 법에서 위임된 사항을 규정하기 위하여「대외무역법 시행령」(이하 “개정령”)이 개정 및 시행됨
- 주요내용은 개정법에서 추가된 전략물자 지정 근거인 “다자간 수출통제 공조”의 구체적인 범위를 규정한 것이며, 무역안보관리원의 ‘홍보·컨설팅’ 및 ‘전략물자 수출입통제 협의회 지원’ 등 기능 추가와 과태료 부과 기준을 정비함
• 이번 개정법령에 따라 전략물자 지정 근거 추가, 무역안보관리원 기능 강화, 집행 등 수출입관리 제도가 전반적으로 개선되었음
< 영문 > Amendments to the Enforcement Decree of the Foreign Trade Act : Reflecting the expanded roles of KOSTI (Enforced on October 8, 2024)
• On Aug.21, 2024, the Foreign Trade Act, as amended on Feb.20, 2024 (hereinafter referred to as “the Amended Act”), was enforced in light of the changing trade security environment and the international trend of strengthening export controls.
1. Added grounds for designation of strategic items
Established grounds for designating strategic items under multilateral export control cooperation in equivalent to the international export control regime
2. Expanded function the Korean Security Agency for Trade and Industry (KOSTI)
Expanded roles such as policy support and analysis of impacts on industries
3. Strengthened enforcement
Penalties for non-compliance of license condition, restrictions on imports and exports in case of violation of suspension orders, and other penalties have been overhauled
• On Oct. 8, 2024, the Enforcement Decree of the Foreign Trade Act (hereinafter referred to as “the Enforcement Decree”) was amended and enforced to regulate affairs delegated by the Amended Act.
- The main amendments includes specified scope of multilateral export control cooperation, which is a new ground for designating strategic items, and expanded roles of KOSTI such as “Public Relations and Consulting” and “Supporting the Council for Control of Exportation and Importation of Strategic Items,” as well as the revised criteria for administrative penalties.
• Thus, the Amended Act has improved the overall import and export management system and enforcement by adding legal basis for designating strategic items and expanding roles of KOSTI.
